1. Acceptance of Terms

By accessing or using Modern Vibe Coding (“the Platform”), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated by reference. If you do not agree to these terms, you may not use the Platform.

2. Free Access, No Accounts

The Platform is free to use and does not require an account. We do not sell subscriptions or process payments. Your learning progress, bookmarks and notes are stored only in your own browser (localStorage) and are not transmitted to us. Clearing your browser data removes them, and we cannot recover them for you. You must be at least 16 years old to use the Platform (or the minimum age required by your jurisdiction).

3. Content & Intellectual Property

All course content, code examples, illustrations, audio and materials are the property of Modern Vibe Coding or its licensors and are protected by copyright and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the content for personal, non-commercial learning purposes. You may not redistribute, resell, publicly share, scrape, or create derivative works from course content without prior written permission.

4. Acceptable Use

You agree not to:

  • Use automated tools (bots, scrapers) to bulk download course content.
  • Attempt to circumvent rate limits or interfere with the Platform's operation.
  • Upload or inject malicious content.
  • Use the Platform for any unlawful purpose.

5. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. COURSE CONTENT IS PROVIDED FOR EDUCATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE PROFESSIONAL ADVICE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MODERN VIBE CODING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

BECAUSE THE PLATFORM IS PROVIDED FREE OF CHARGE, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE PLATFORM SHALL NOT EXCEED ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

7. Indemnification

You agree to indemnify, defend, and hold harmless Modern Vibe Coding and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

8. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

9. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Modern Vibe Coding is established, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Platform shall first be addressed through good-faith negotiation. If the dispute is not resolved within 30 days, either party may pursue resolution through the competent courts of that jurisdiction. Nothing in this section limits your rights under mandatory consumer protection laws of your country of residence.

10. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, internet or power outages, government actions, or failures of third-party service providers.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
